These Terms of Service ("Terms") are a binding agreement between you and Kalabash Group LLC ("Ussembly," "we," "us," or "our"), governing your use of the Ussembly mobile application and related services (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.
You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use Ussembly. By using the Service you represent that you meet this requirement and that the information you provide is accurate.
Ussembly helps you build and explore a trusted network — connecting with people you know, giving and receiving endorsements, and discovering people and topics. Features may change, and we may add, modify, or discontinue parts of the Service at any time.
You agree not to:
Zero tolerance for objectionable content and abusive behavior. There is no tolerance for objectionable content (including harassment, hate, threats, sexually explicit material, or impersonation) or abusive users. You can report another user's profile or content from within the app (open the person's profile, then the menu, and choose Report), and you can sever a connection at any time, which immediately revokes that person's ability to message you. We review reports and will remove violating content and may suspend or remove offending users, typically within 24 hours of becoming aware. To report a concern outside the app, email support@ussembly.com.
You retain ownership of the content you submit (profile details, photos, endorsements, messages — "User Content"). You grant Ussembly a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display your User Content solely to operate and improve the Service. You represent that you have the rights to the content you submit and that it does not violate these Terms or any law.
Your use of the Service is also governed by our Privacy Policy, which explains what we collect and how we use it.
The Service relies on third parties (for example, Google Firebase for diagnostics and analytics, Sendly for SMS delivery, and the Apple App Store and Google Play). Your use of those services may be subject to their terms, and we are not responsible for them.
You may stop using the Service and delete your account at any time (see Account & Data Deletion). We may suspend or terminate your access if you violate these Terms or to protect the Service or other users. Sections that by their nature should survive (including 5 and 10–13) survive termination.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that endorsements or connections are accurate.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KALABASH GROUP LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (a) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (b) USD $100.
You agree to indemnify and hold harmless Kalabash Group LLC from claims, damages, and expenses (including reasonable legal fees) arising from your User Content, your use of the Service, or your violation of these Terms or any law or third-party right.
These Terms are governed by the laws of the State of New York, USA, without regard to conflict-of-laws rules. You agree that the state and federal courts located in New York will have exclusive jurisdiction over any dispute arising from these Terms or the Service. If any provision is unenforceable, the rest remains in effect.
We may update these Terms. We will post the updated version and revise the Effective Date; we may communicate material changes through the App. Continued use after changes means you accept them.
